Meru senator Mithika Linturi now wants the Court to lift orders restraining him from accessing his Runda home saying Marianne Kitany has never been his wife.

In a thinly veiled attack aimed at Kitany, his lawyer Muthomi Thiankolu seemed to paint her as a”Slay Queen”.

“If slay queens and prostitutes can rush to court and obtain orders as if those lawfully married don’t exist, court must remove itself from making an adversarial position,” he argued today .

According to Thiankolu, Kitany obtained the said orders after she claimed that she was in a domestic relationship with Linturi which was not true as the senator has been in a monogamous marriage for the last 18 years.

According to the senator, if the orders barring him from accessing and evicting the Runda home are extended, the court will create precedence saying all marriages in Kenya are polygamous.

Linturi argues that Kitany has also gone to desperate lengths to show that that he had capacity to enter a customary marriage and even produced fake documents in court to show she had capacity to enter customary marriage.

“The documents are fake because Linturi has never filed a divorce matter between him and his wife Mary Kaimenyi. There is a letter from catholic priest in Tigania that solemnized the marriage,” stated Linturi’s lawyer in court yesterday.

According to the senator, the orders if extended, will be seen to be encouraging adultery and diminishing the institution of marriage.

The court further heard that there was no evidence to show Linturi has caused domestic violence and that Kitany was not one of those marginalized or vulnerable women as claimed as she owns properties in Kileleshwa, South B and Lavington.

According to the senator, he has never established any domestic or marital relationship with Kitany or any of her children as they were merely guests at the Runda House.

Kitany’s lawyer Danstan Omari asked the court to extend the said orders saying the court must restore the dignity of women and it will be a great calamity for men to use women and dump them.

Omari told the court that Kitany’s personal clothing have been found in the Runda house and that have been spending quality time together since 2005 and to date there exists a relationship.

“My client has an inherent dignity which should be protected violence demeans a person in that relationship. It’s our submission that Kitany has faced the gravest of injustice occasioned by a person so loving, dear, caring only to turn out to be the greatest tormentor,” said lawyer Omari in court.

According to Kitany’s lawyer, the court has jurisdiction to grant orders it issued whether a person is referred to as a prostitute, slay queen or any word that is used in a stay dump relationship.

Senior Resident Magistrate Isaac Orenge will rule on February 1 whether he will grant the orders on permanently.
