Former nominated Senator Paul Njoroge at Milimani law courts.
Former Nominated Senator Paul Njoroge Ben wants the court to declare the August 9th 2022 presidential election Illegal and unlawful as decided by the IEBC.
He argues that IEBC made the declaration that the next general elections be held on 9th of August it was improperly constituted as it did not have the requisite proper quorom of its commissioners.
Through an application filed in court the senator claims that IEBC has lessened, determined and or shortened the Five (5) years Constitutional terms of the president and his deputy with the scheduled date of the Presidential Elections of August,9,2022.
“The 1st Respondent has illegally, unlawfully and irregularly declared, decided, determined and/or directed that the next Presidential Elections be held on the 9th August, 2022.” Read the application by the senator.
The Senator further claims that Pursuant to the intended Presidential Elections of August,9th 2022 the IEBC has illegally, unlawfully and irregularly procured and/or is in the process of procuring very costly hardware and software materials and personnel to be deployed in and/or engaged in the said intended Presidential Election.
He claims the last election was held on October,26th 2017 by the electorate body whuch declared president Uhuru Kenyatta and his deputy William Ruto victorious and were sworn
in on the 28th of November, 2017 as the President and Deputy President of the Republic of Kenya.
“This Honourable Court has the power, mandate, duty and jurisdiction to avert any and all further breaches of the Constitution and other written laws by the Respondents jointly and severally pending hearing and determination of the Application and the Petition herein”read the application.
