High court judge Maureen Onyango has declined to suspend her orders that revoked the appointment of Prof Stephen Kiama as the University of Nairobi vice chancellor.
Instead the judge directed that the case be heard inter-party this Friday and certified it as urgent.
In an urgent application CS George Magoha says that the court was misled by professor Kiama into issuing ex parte orders adding that there’s currently a vacancy in the office of the vice chancellor.
The judge was asked to stay or vary the orders so that the CS can appoint an acting vice chancellor/Deputy vice chancellor to enable the University continue with its critical administrative functions and to stop misrepresentation by Kiama as the vice chancellor of the institution.
In the application he says that the ex parte orders issued on Monday in effect paralyses the proper functioning of the University saying that there is a lacuna in the of the vice chancellor and the council of UoN.
“Unless the ex-parte orders are set aside, the University of Nairobi is unable to undertake critical administrative functions required of the office of the Vice Chancellor and the council of UoN,”reads court papers.
Lawyer Evans Monaro for the CS argued that despite the lacuna, Stephen Kiama has proceeded to misrepresent himself as the purported vice chancellor of the University making drastic decisions as pertains the running and management of the institution and deceiving the public.
