- Kenya alliance of non -formal schools have moved to court seeking to quash circular issued on 26th september 2019 by the ministry of education directing closure of all non registered schools and transfer of learners to public school,saying the directive has negatively impacted on KCPE candidates in preparation for the exams.
- In a certificate of urgency filed at Milimani law courts the association says 20,000 non-formal school where in over 2Million learners are enrolled will be affected by the directive.
- The applicant further wants an order prohibiting the respondents from implementing the circular pending the hearing and determination of the suit.
- The association chairman Allan Masika have called for immediate resignation of the Permanent secretary for education Richard Belio Kipsang saying he is misleading the executive especially CS Prof George Magoha.
He further asked for speedy investigations to junior education officers who are extorting the said schools for money. - In the application the association have sued the Permanent secretary state department of early learners.
- They told the court that the directive was issued at a time when the learners are waiting for the KCPE and end of the year exams.
The chairman said by close of business yesterday over 100 schools had been closed.
“The current disruption and confused which has been witnessed by the circular will negatively impact on the outcome of KCPE” said their lawyer. - In court documents the petitioners say the circular was issued without proper consultation and it’s effront to the right of fair administration.
- The applicant further claims if the circular is not stopped over 2M learners will be denied right to education.
