The Kenya Bureau of Stands Acting MD Bernard Nguyo has been re-ordered to appear in court tomorrow failure to which a warrant of arrest will be issued in a case in which former MD Charles Ongwae and nine others are faced with charges of attempted murder.
Senior Principal Magistrate Kennedy Cheruiyot said instead of the MD appearing in court he chose to send his lawyer Mr Joram Arwa, indicating that he was aware of the summons to appear.
He said that a letter done by Senior Counsel Paul Muite on the material days when the summons were issued and sent to Nguyo is further clear indication of service of the court order.
Cheruiyot, said that the MD has to come and explain why the orders issued on 15 January 2019 requiring sampling and testing of the Fertilizer have not beencomplied with.
The court had directed the testing be done in the presence of all the accused and an Interdependent laboratory, the samples be taken on Wednesday and testing be conducted on 21 February 2019.
lawyers Paul Muite and Edward Oonge had objected to testing carried out by the government in their absence.
They applied to the trial court seeking an order for fresh testing of the fertilizer in their presence, the court did allow the application on 15 January 2019.
