- Highcourt judge Justice Jessy Lesiit has dismissed an application by Oyamo and Obiero seeking to recuse herself from hearing murder trial against them.

- The judge in her ruling said that the two failed to prove any biasness against the judge.
The judge also said that their application was made out of perception of conviction. - In the case, Oyamo and Obiero claim that they do not stand a chance of justice before Justice Lessit as she has had released the Governor while ordering that they remain in remand until the case is settled.
- According to Obiero, the judge had allegedly made up her mind on him despite not being mentioned as being one of those who carried out the gruesome murder.
- Oyamo in the application claims that the judge was biased against him as she had allegedly made a comment of him admitting to have participated in the murder.
But in the ruling the judge has denied any biasness saying the observation made in her ruling on bail was based on response by the state. - She said such observations by a judge cannot determine the outcome of the trial.
In the ruling the judge said that the two believe the court acted discriminatory when the judge failed to grant them bail. - In the ruling for bail application the judge had observed that the two acknowledge the evidence in their affidavits and that such evidence cannot be brushed aside.
- The judge went ahead and said that the two made Specific affirments implicating each of them.
The judge has further said there was misconception of the ruling of the court and it was taken out of context - The court has further directed that the pre trial be conducted on 9th October.
