“Bail is a constitutional right and there is no compelling reasons to detain the accused for more days,” said Ojienda.
Ojienda added that the fact that the accused have been charged is a clear indication that the prosecution have completed their investigations.
Lawyer Sam Nyamberi who is representing Wairimu said the offense is bail able and the grounds to detain the accused further should be compelling enough.
“Detaining the accused further will be an affront of their rights,” said Nyamberi.
He added that the court ought to have been informed whether the accused will jeopardize the investigation process.
Nyamberi added that any more minutes of detention without reasons is an abuse of court process.
“Court should not be persuaded by the figures,” said Nyamberi.
