- In an application filed at Milimani law court waititu has sued,the senate,the speaker of the senate,the speaker county government of kiambu and the deputy governor kiambu county james Nyoro.
- Through his lawyers waititu says the motion of the impeachment by kiambu county government presented and debated outside the 14 days time as stipulated by kiambu county standing orders.
- He says the respondents bluntanly ignored,refused and failed tp adhere to the standing orders 83 thus there was no proper motion to be debated by the mcas.
- In court documents waititu claims that according to standing order 82 of the kiambu county government where a special motion fails to adhere and observe the timelines stipulated under same order such motion should have deemed to have been withdrawn and the same should not have been moved again in the same section except with the consent of the speaker.
- Waititu further claims the kiambu county extended the sitting during the debate of the motion to impeach him in contravention of standing orders 41 of the county assembly.
