Activist Okiya Omtatah has moved to court to challenge the recent appointments made by the state to key parastatals. 

It is his argument that the state is in breach of court orders that directed the appointment be made based on the law, on the Constitution and should be fair, open, competitive, merit based and through an inclusive process.
He argues that the said directive or orders became effective and binding immediately.

“On 4th and 8th February 2019, the respondents defied the said Orders when they handpicked and appointed individuals to be chairpersons and members of boards of State corporations and state agencies,”argues Omtatah
He says that the state is aware of the court orders adding that they appealed against the judgment and having filed an application to set aside the orders.

Omtatah argues that the appointments were made in defiance of the Orders of the Court and are unconstitutional and, therefore, invalid, null and void.

Former Kajiado governor David Ole Nkedienye, former Mwingi Central MP Joe Mutambu and former Machakos governor contestant Wavinya Ndeti are some of those who were appointed to head the boards of various government agencies.

The national executive of the Republic, Public Service Commission, State Corporations Advisory Committee and the AG have been named as respondents.
